The defendant Hundley by Writ of Error challenges that portion of a decree of the Chancellor which awards $1,055.00 damages to the complainants Tucker due to breach of a contract to sell realty.

*3The issues were heard by the Chancellor on oral testimony, sitting without a jury. The defendant admits the Bill of Exceptions was not filed within the time allowed by law, and for this reason an appeal to this Court could not be perfected.
