Petitioners, in an original proceeding here, ask for Writ of Prohibition to prohibit the Pulaski Probate Court from, proceeding further in connection with an Order made November 9, 1953, appointing a Special Administrator in the matter of the Estate of Merwin I. Moore, who died testate August 5, 1953.

Under the provisions of the purported will, J. A. Breshears was named executor, and also trustee of the entire estate. On August 10, 1953, the alleged will was admitted to probate and Breshears was duly appointed executor and trustee. The above instrument was probated in common form, without…
