GIBSON, District Judge.

STATEMENT OF THE CASE

This action is a civil action arising out of a two-car accident which occurred in the State of Connecticut on May 15,1960. The plaintiff is a resident of the State of North Carolina and the defendants are residents of the State of Vermont. Wayne Shattuek was the driver of a ear which was owned by his stepfather, Philip Howard.

The plaintiff originally brought this action in the District Court for the Middle District of North Carolina in April 1962. That suit was dismissed because of the plaintiff’s inability to secure personal jurisdiction over the…
