This case was heard below on the pleadings. The plaintiff, Raymond W. McLaughlin of Lunenburg, Vermont, brought an action of tort against the defendant, Elwin N. Blake of Lyndon, Vermont for negligence in the operation of a motor vehicle. The complaint alleges that due to the defendant’s negligence the plaintiff was injured in an automobile accident occurring on December 18, 1952 at a point in southern Quebec, Canada.
