This matter is before the court on defendant’s motion to dismiss for lack of subject matter jurisdiction pursuant to RUSCC 12(b)(1). The action arises out of the efforts of the United States Environmental Protection Agency to decontaminate Quail Run Mobile Home Park in Franklin County, Missouri. Plaintiff originally brought this *712action in the United States District Court for the Eastern District of Missouri, under the Federal Torts Claims Act, 28 U.S.C. § 2671 et seq. (1982).
