Petitioner John Pinckney (“Petitioner” or “Pinckney”), a pro se state prisoner, seeks habeas corpus relief under Title 28, United States Codes Section 2254. This matter has been reviewed by the United States Magistrate Judge and is currently before the court upon the recommendation that summary judgment be entered in favor of Respondents. The record includes the Report and Recommendation of the Magistrate Judge (“R & R”), which was made in accordance with 28 U.S.C. § 636(b)(1)(B).
