Appellant entered judgment on a bond and warrant of attorney accompanying a mortgage, and levied on the mortgaged property, which then belonged to appellee, he having acquired title thereto by a sheriff’s sale on an execution issued on a judgment entered against the mortgagor, after the date of the recording of the mortgage, but on an agreement which antedated it.
