At the audit of the executor’s account in this estate, appellant, who is a son of testator, claimed to be given a child’s share therein, or, if this was not allowed, then to have awarded to. him the sum of $5,000 with interest, it being the amount of a promissory note of testator’s, delivered to a trustee for appellant, the giving up of a claim upon which note he alleged, and appellees denied, was intended to be the consideration for making a will in his favor.
