*655In an action to recover damages for unjust enrichment and to recover in quantum meruit for services rendered, the defendant One Point Street, Inc., appeals, as limited by its brief, from so much of an order of the Supreme Court, Westchester County (R. Bellantoni, J.), entered March 23, 2009, as granted that branch of the plaintiffs motion which was to strike its answer pursuant to CPLR 3126 (3).
Ordered that the order is affirmed insofar as appealed from, with costs.
