The Liquids Dispatch Line, a partnership of Chicago, Ill., sued Texas Power & Light Company, a corporation of Dallas, Tex., to recover $6,600 damages for the breach of an alleged contract, under the terms of which plaintiff leased to the defendant ten tank ears for a period of one year, for which it agreed to pay a monthly rental of $95 for each ear.
The corporation defended on the ground that no such contract, as alleged by plaintiff, was ever entered into between the parties. This issue presented to the court below, and presents to us, the only material question for determination.
