The plaintiff, Harrison B. Nixon, commenced an action in the district court of McPherson county, Kansas, against the defendants, School District No. 92, of McPherson county, and the officers of such district, to restrain them from erecting, Or attempting to erect, a school house upon a certain site designated and described in the plaintiff’s petition. A temporary restraining order was granted by the probate judge of the county. Subsequently the defendants filed a motion to dissolve the temporary restraining order, which motion afterward…
