Presently before the court is defendants’ motion to dismiss (doc. # 5). Plaintiff filed a response in opposition (doc. # 10), and defendants filed a reply (doc. # 11).
I. Background
Plaintiff began working at defendant Atwood Urgent Dental Care, PLLC (“Atwood Urgent”) in or around July 2010. (Doc. # 1, Compl. at ¶ 8). Atwood Urgent is a “24/7” dental practice that served patients after business hours. (See id. at ¶ 9). Plaintiffs duties included assisting defendant Dr. Aaron Atwood with dental procedures in addition to office and clerical work. (Id. at ¶ 8).…
