The Court has before it, in this diversity action, the Motion of Defendants, Central States Dredging Company (“Central States”) and APAC-Tennessee, Inc. (“APAC”), for Summary Judgment. The issue presented by Defendants' Motion is whether Plaintiff, Fordice Construction Company (“Fordice”), the second low bidder on a government procurement contract set aside for small businesses, can assert state law claims for unjust enrichment and fraud against Central States, the successful low bidder, and APAC, Central States’ subcontractor and alleged…
