John Flis, administrator of the estate of Bruno Flis, deceased, appellee, hereinafter called the plaintiff, sued the City of Chicago, a municipal corporation, appellant, hereinafter called the defendant, in an action on the case to recover damages for the benefit of the next of kin for the alleged wrongful death of plaintiff’s intestate. The case was tried before the court, with a jury, and a verdict was returned finding the defendant guilty and assessing the plaintiff’s damages at $5,500.
