This was an action by M. Gorman, as plaintiff, against J. M. Miller, as defendant, to recover double the rental value of certain real property, which it was alleged Miller willfully held over after the end of his term. For convenience the parties will be hereafter referred to as they appeared in the trial court.

It appears that the defendant had been for several years, occupying certain real estate in Ardmore as the tenant of the plaintiff; that in June, 1917, the plaintiff brought an action of unlawful detainer against the defendant before a justice of the peace in Ardmore, in which action…
