This suit was brought by appellees against the appellant for damages alleged to a shipment of cattle from Encinal, Texas, to Ryan, Indian Territory, over the road of appellant and its connecting lines.

The appellees claim in their petition, (1) that prior to the time of the shipment they had made a contract with appellant to have cars at Encinal to carry their stock at certain times, and had a fixed rate of freight; and (2)) that if there were no contract for cars at the time alleged, their negotiations and transactions regarding same constituted legal notice and…
