In this action for an injunction to permanently enjoin the defendants from enforcing Local Law No. 3-74 of the Town of Huntington entitled “ Tow Truck Law ”, plaintiffs move for summary judgment claiming that said local law is arbitrary, capricious and unreasonable, and therefore unconstitutional and void. The plaintiffs are engaged in the tow truck ¡business, excepting that Bi-County Towmen’s Association, Inc. is a not-for-profit corporation whose members are tow truck operators in Nassau and Suffolk Counties.
