Appellant has been convicted by a Court of Special Sessions in Nassau County of having violated an ordinance of the Town of North Hempstead which prohibits “ through or transient vehicular traffic ” on streets within an area in or near the village of New Hyde Park. Appellant questions the validity of this ordinance, without contesting that he did "what the language purports to prohibit. The ordinance is challenged upon the ground that it is not a valid exercise of any power which has been delegated by the State to the town board of North Hempstead.
