Lovins, Judge:

A grand jury of Pocahontas County returned an indictment charging Lawson Jordan Cutlip, Vesper Ray Cutlip, Birdie Nancy Dean, and Charles Alexander with burglary, breaking and entering and larceny. The first count of the indictment charges that defendants broke and entered an outhouse adjoining a dwelling house owned by The Chesapeake and Ohio Railway Company, and occupied by Parker Curry.
