On the 12th day of March, 1888, Stape Hall, Bailey Hall and Will Oox were indicted in the Circuit Court of Mercer county for burglary. The indictment contained two counts, *494—the first charges that the defendants, “ on the 15th day of February, 1888, about the hour of 10 o’clock in the nighttime of that day, feloniously and burglariously did break and enter into the dwelling-house of one L.
