HUXMAN, Circuit Judge.

The question presented by this appeal is whether on the date of his death, November 15, 1954, John S. Likens was *898covered by a group insurance policy issued to Liebmann Properties by the John Hancock Mutual Life Insurance Company on the lives of Liebmann’s eligible employees. The trial court held that the Likens policy had lapsed and that there was no liability.
