This is a class action, brought under 42 U.S.C. § 1988, on behalf of certain Georgia state prisoners classified as Level V offenders under the Georgia Parole Decision Guidelines System (the “Guidelines”). The class contends that a recent change in the method for calculating the Tentative Parole Month (“TPM”) of Level V offenders under the Guidelines has been applied retroactively in violation of the Ex Post Facto Clause of the United States Constitution.
