Appellant David Martinez (“Martinez”) appeals from a judgment entered on April 19, 2004, in the United States District Court for the Southern District of New York (Preska, J.), sentencing him principally to 115 months’ imprisonment for violation of 18 U.S.C § 922(g)(1), which prohibits the possession of firearms by convicted felons.
