This appeal presents an action in damages by Harry F. McCool as plaintiff against William Lea Taylor and David Neil as defendants, which was commenced in the Circuit Court of Hamilton County. An exchange of “show horses” by McCool and Taylor was the origin of the difficulty. Neither of the defendants is a resident of Hamilton County, Tennessee. Neil, upon whom personal service was secured in McCool’s office in Chattanooga, Tennessee, is a resident of Walker County, Georgia; and Taylor, upon whom service was secured by counterpart summons, is a resident of Shelby County, Tennessee.
