The National Labor Relations Board (the “Board”) seeks enforcement of its order finding that Speedway Petroleum, Division of Emro Marketing (the “Company” or “Speedway”) had committed an unfair labor practice as defined in § 8(a)(1) and (5) of the National Labor Relations Act (“NLRA”), 29 U.S.C. § 158(a)(1) and (5), by refusing to bargain with the Board-certified United Food and Commercial Workers International Union, Local No. 35 (the “Union”).
