This is an action in ejectment. Motion has been made by the plaintiff to strike out the answer filed by the defendant in the above stated cause upon “the ground that the allegations contained in the same are not true in fact and sham; and on' the further ground that as to the other allegations contained in the answer, they are frivolous.” In support of the motion, affidavits were resorted to.
