This is an appeal from a summary judgment entered in favor of the plaintiff upon the striking out of defendant’s answer.

The plaintiff’s claim is based upon a judgment recovered against defendant’s assured for damages sustained as the result of an automobile collision, which he was unable to collect from the judgment debtor. The policy of insurance contained the New Jersev Financial Responsibility act endorsement under which a liability is created against the defendant in favor of the plaintiff for the amount of the judgment obtained…
