Movant, Ronald Drake, appeals from the denial of his second Rule 27.26 motion without an evidentiary hearing. Drake was convicted by a jury of first degree murder and sentenced to life imprisonment. His conviction was affirmed on direct appeal. State v. Drake, 518 S.W.2d 335 (Mo.App., E.D.1975). Drake then brought his first Rule 27.26 motion which was denied after an evidentiary hearing.
