In 1928 and 1929 the copartnership of Glenny, Monro & Moll (hereinafter called Glenny) was engaged in business in the city of Buffalo dealing in investment securities and acting as a broker. On the 13th day of February, 1929, the plaintiff gave Glenny an order to purchase for him 500 shares of the preferred stock of Consolidated Automatic Merchandising Corporation, which was at that time listed and dealt in on the New York Curb Exchange, at thirty-five dollars and fifty cents per share or better.
