The original complaint in this action, filed as a class action by plaintiff Chester Washington against George K. Wyman, Commissioner of New York State Department of Social Services and Jack Goldberg, Commissioner of New York City Department of Social Services, combines two substantive issues: 1) whether the New York City Department of Social Services Procedure Number 70-30 (hereinafter “70-30”) is violative of the constitutional rights of welfare recipients to pretermination hearings established in Goldberg v.
