This matter is before the Court on the motion of defendant Blue Cross & Blue Shield of Rhode Island (“Blue Cross”) for partial summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Specifically, Blue Cross seeks to strike the state law claims and jury demand asserted by plaintiff, Michael A. Kelly, in Counts I, II, and III of the Amended Complaint.
