MEMORANDUM OPINION AND ORDER
SUSAN RICHARD NELSON, District Judge.
This matter is before the Court on Defendants’ Motion to Dismiss [Doc. No. 9], and Plaintiffs Motion to Appoint Interim Class Counsel [Doc. No. 16]. For the reasons stated below, Defendants’ Motion is-granted in part, and denied as moot in part, and Plaintiffs Motion is denied without prejudice.
