*314This is an action of ejectment for the possession of a lot situated in the town of Red Bluff, in the county of Tehama. The plaintiff relies for recovery upon a patent of the State of California, embracing the premises in controversy, issued to him upon a location of three hundred and twenty acres of land, of the 500,000 acres granted to the State by the Act of Congress of September 4th, 1841.
