MEMORANDUM OPINION AND ORDER

This matter is currently before the court on the defendant’s motion for summary judgment on all of the plaintiffs causes of action, the defendant’s alternative motion to dismiss for failure to state a claim plaintiffs action based on inadequate grade crossing warning devices, and the plaintiffs motion for summary judgment on his claim for failure to sound statutorily required warnings.
