1. This action involves the title to 40 acres of land, both plaintiff and defendant claiming title by deed from a common source. It appears that one Mollie Hawkins, a Creek negress, was the original owner, and both plaintiff and defendant claim to have received a deed from her. The plaintiff claims to have purchased the land in controversy on the 16th day of December, 1908, and to have gone into possession in January, 1909, and to have remained in possession, having made valuable improvements thereon and cultivated and resided thereon with his family.
