Affirming.. Some time prior to the year 1900 John W. Smith, of Pibe county, this state, under proper proceedings instituted in the Pike circuit court, was by the verdict of a jury and judgment of that court found and declared-to be a person of unsound mind and sent to the lunatic asylum at Lexington, Kentucky, for confinement and treatment, where he remained until his death in the year 1917. When incarcerated in the asylum and at the time of his death he owned two adjoining tracts of land, one of 227, the other of 54 acres, in Pike county. He had and was…
