On November 17, 1994, plaintiff brought suit under 42 U.S.C. § 1983, alleging that Michael A. Nelson violated his rights to free exercise of religion under the First Amend ment to the United States Constitution by (1) enforcing a policy of the Department of Corrections [DOC] which prohibited the wearing of religious head wear in common areas of the correctional facility; (2) preventing him from attending Islamic prayer services; and (3) preventing him from observing Ramadan. 1 This matter comes before the Court on defendants’ renewed Motion For…
