PHILLIPS, Senior Circuit Judge:

Ronald Bennett was convicted of capital murder and sentenced to death by a Virginia jury. After exhausting his direct state appeals and unsuccessfully petitioning the Supreme Court of the United States for certio-rari, Bennett sought habeas corpus relief in state court.
