Appellant stands convicted of offenses1 arising from a bar fight in Mainz, Germany, including unpremeditated murder.
On January 6, 1989, appellant and some friends met at an apartment and began drinking alcoholic beverages before going to Charly’s Club, a disco where appellant’s girlfriend worked. Meanwhile, Specialist Jonathan Gray, Private Richard Livingston, and Private Joe Seitz (the deceased) drank several beers at a bar called Mainzer’s before going to Charly’s, which was nearby.
