When this cause was before us at June term, 1879,-upon an appeal from an order denying the petitioner’s application to become a party plaintiff, we remarked that “ the answer sets up substantially the same matters of de-fence to thé application which are relied on in the original answers,” and that the issues thus made “should have been first determined before the summary order of the court.” Accordingly at spring term, 1880, the following decretal •order was entered:
