KLEINSCHMIDT, Judge.

The State of Arizona appeals the dismissal of an indictment against Howard Chan and Mary Wong, who were charged with conspiracy to commit theft and attempted trafficking in stolen property. The trial judge found that the court lacked jurisdiction to hear the case because the Defendants were never in Arizona. The court found that the acts which were committed in Arizona by the co-conspirator, David Cho, could not be imputed to the Defendants because Cho was an agent of the police.
