This case arises from a post-conviction petition for DNA testing related to the 1979 robbery, kidnapping, and murder of Virgil Harris in Louisville, Kentucky. Appellant, Brian Keith Moore, was convicted of the crimes and sentenced to death. This Court overturned the initial conviction and remanded for a new trial. See Moore v. Commonwealth, 634 S.W.2d 426 (Ky.1982). On retrial, Appellant was again convicted and sentenced to death. This Court affirmed the conviction and sentence. See Moore v.
