This contract dispute comes before the court on the government’s motion for partial summary judgment. The ease arises over a *445contract entered into in 1997 between the United States Army Corps of Engineers (“Corps” or “COE”) and Johnny F. Smith Truck & Dragline Service, Inc. (“Smith”). Necessitated by the floods in the City of Grand Forks, North Dakota, in the spring of 1997, the contract provided for disaster-related demolition and disposal services.
