This case was certified to us by The Judge Advocate General, United States Navy. The accused, Brasher,' was tried by general court-martial1 at the United States Naval Station, San Diego, California, on December 7, 1951, and found guilty of two instances of unauthorized absence, in violation of the Uniform Code of Military Justice, Article 86, 50 USC § 680; and of breaking arrest, in violation of the Uniform Code of Military Justice, Article 95, 50 USC § 689.
