The- defendant in error moved to dismiss this appeal’ for ¡the reason that the case-made does not contain an averment by way of recital that it contains all of the evidence introduced or submitted on the trial of the cause. The trial court sustained a demurrer to the evidence of the plaintiff, and the only assignment of error argued in the -brief of plaintiff in error is that the court erred in’ sustaining this demurrer to> the evidence.
