I. INTRODUCTION
THIS MATTER is before the Court on the August 22, 2005 Motion for Summary Judgment of Defendant, United Corp., d/b/a Plaza Extra [hereinafter “Defendant” or “Plaza”]. Defendant asks this Court to find that Plaza had neither actual nor constructive notice of any substance on the floor of its establishment that may have caused Plaintiffs injuries.
