MILLER, Judge.

Donald F. Kopis and Mildred E. Kopis appeal from the judgment below in which the trial court found they had failed to return a $40,000 deposit given them by Norman Savage during negotiations involving the sale of a nursing home. The trial court originally awarded Savage the amount of the deposit plus 8% prejudgment interest, treble damages of $120,000 for conversion, $399,314 fraud damages and $250,000 punitive damages, attorney fees in the amount of $30,000, and costs in the amount of $1,345.91.
