{¶ 1} Defendant-appellant, Dwight Lane Reynolds, appeals a decision of the Montgomery County Court of Common Pleas that overruled his application for postconviction deoxyribonucleic acid (“DNA”) testing. Reynolds filed his memorandum in support of his application for postconviction DNA testing on February 13, 2008. On April 29, 2008, the state filed its responsive brief. Reynolds filed a reply to the state’s memorandum on May 23, 2008. The trial court filed its decision and entry overruling Reynolds’s application on November 25, 2008.
