Appeal by plaintiff from an order of the district court for Hennepin county, Smith, J., sustaining a demurrer to the complaint.

This action was brought to recover damages for personal injuries suffered by the plaintiff, while in the employment of the defendant, through the alleged negligence of a fellow servant. The question presented by the demurrer to the complaint was whether the facts alleged brought the case within the operation of Laws 1887, c. 13 (G-. S. 1891, § 2701), making railway companies liable to their servants for damages caused by the negligence of a fellow servant.
