Appeal from Montgomery District Court. — PI.on. "W. R. Green, Judge. Action at law to recover for personal injuries alleged' to have been caused by negligence on the part of the defendant. There was a trial by jury, and a verdict and judgment for the plaintiff. The defendant appeals.

Por about two and a half years before the month of August, A. D. 1892, when the accident in question occurred, the plaintiff had worked for the defendant in its-coal house at Red Oak. IPis duties required him to shovel coal from the cars into chutes, to break the coal and wet it for use, and to assist in filling the tenders of locomotive engines with coal. In the month referred to, the coal house was rebuilt; and, while that was being done, tenders were-supplied with coal from cars which were placed on the coach track next to the main line.
